On August 31, 2023, the National Institutes for Food and Drug Control issued the ChildrensCosmetics & Personal CareTechnical Guidelines. Compared to the previous Draft for Comments, the newly released Guidelines have been adjusted in several aspects.
Changes to the Filing Application Form
The requirements for filing applications for imported childrens cosmetics are clarified, and changes to declared information are not allowed arbitrarily. Compared to the Draft for Comments, the Guidelines have expanded in terms of efficacy claims and product dosage forms.
Naming of Product Names
Added requirements for explanations of non-Chinese trademark names. The naming requirements for product sales packaging are consistent with the current Cosmetics Labeling Management Measures.
Requirements for Product Formulation
Ingredient Selection (a) Requirements for using new technologies in ingredient preparation are clarified. (b) Ingredients with safety risks are not recommended for use. (c) Restrictions on colorants, preservatives, and sunscreens have been relaxed but still have usage limits.
Product Compliance Standards (a) The control ranges for microbiological and physicochemical indicators have been adjusted. (b) Examples of special ingredient usage have been added to the safety warning language section.
Product Labeling Requirements
Sales packaging requirements are consistent with current regulations. Claims regarding waterproof performance and sun protection efficacy have been adjusted.
Product Inspection Report
Toxicological test results for childrens cosmetics must show no irritation, no sensitization, and no phototoxicity.
Product Safety Assessment Documentation
Added descriptions of childrens physiological characteristics. Requirements for allergen content in fragrances have become stricter.
The newly released Technical Guidelines for Childrens Cosmetics has been improved and adjusted in multiple aspects compared to the Draft for Comments. Enterprises need to fully understand and comply with these new technical requirements during product development, production, and sales processes.
